BSMNT is a video production project management platform operated by Below Studios Limited, a company registered in New Zealand ("we", "us", "our"). The service is available at bsmnt.co.nz and via any associated mobile or desktop applications.

You must be at least 16 years old to use BSMNT. By using the service, you confirm that you have the authority to enter into a binding agreement on behalf of yourself or your organisation.
You are responsible for keeping your login credentials secure. You must notify us immediately at taylor@below.co.nz if you suspect unauthorised access to your account. We are not liable for losses caused by unauthorised access where you have not taken reasonable steps to secure your account.
You may not share accounts or create accounts for the purpose of circumventing subscription limits.
You own your content. Project data, shot lists, runsheets, storyboards, budgets, time logs, and any other material you create in BSMNT belongs to you.
By using BSMNT, you grant us a limited, non-exclusive licence to store, process, and display your content solely to provide the service. We do not claim ownership of your content and will not use it for any purpose beyond operating BSMNT.
You are responsible for ensuring that content you upload does not infringe the intellectual property rights of others.

We reserve the right to suspend or terminate accounts that violate these terms without notice.
BSMNT includes AI-powered storyboard image generation, powered by Anthropic's Claude API. When you use these features, your text prompts are sent to Anthropic to generate images. We do not send personal data or project metadata to Anthropic beyond the prompt text you explicitly enter.
AI-generated content may occasionally be inaccurate, incomplete, or unexpected. You are responsible for reviewing and approving any AI-generated material before using it in a professional context.
Anthropic's usage policies apply to AI features — content that violates those policies (e.g. harmful or illegal imagery) cannot be generated through BSMNT.
If you connect your Google Calendar, you grant BSMNT permission to read and display your calendar events within the app. We access this data via Google's OAuth 2.0 protocol and do not store calendar data on our servers beyond your active session. You can disconnect Google Calendar at any time from your account settings.
Some features of BSMNT require a paid subscription. Subscriptions are billed on a recurring basis (monthly or annually) via Stripe. By subscribing, you authorise us to charge the payment method on file for each renewal period.
Cancellations: You may cancel your subscription at any time. Your access will continue until the end of the current billing period. We do not offer refunds for partial billing periods.
Price changes: We will give at least 30 days' notice before changing subscription prices, and changes will apply from your next renewal date.
If a payment fails and cannot be resolved within 7 days, we may suspend access to paid features until payment is resolved.
We aim to keep BSMNT available and reliable, but we do not guarantee uninterrupted access. We may occasionally take the service offline for maintenance, updates, or circumstances beyond our control.
We reserve the right to modify, suspend, or discontinue any part of the service at any time. If we discontinue the service entirely, we will provide at least 30 days' notice and offer data export.
We may update these terms from time to time. Continued use of BSMNT after an update constitutes acceptance of the revised terms. We will notify active users of material changes by email.
We are not liable for indirect, incidental, consequential, or punitive damages, including loss of data, loss of profit, or loss of business, even if we have been advised of the possibility of such losses.
Nothing in these terms excludes or limits liability that cannot be excluded under the New Zealand Consumer Guarantees Act 1993 or the Fair Trading Act 1986. However, if you are using BSMNT for business purposes (which is its primary purpose), the Consumer Guarantees Act does not apply.
You agree to indemnify and hold harmless Below Studios Limited and its directors, employees, and contractors from any claims, losses, or damages (including legal costs) arising from your use of BSMNT, your content, or your violation of these terms.
BSMNT, its design, code, branding, and all content created by us remain the intellectual property of Below Studios Limited. These terms do not grant you any right to use our brand, trademarks, or logos without our written permission.
Our collection and use of personal information is described in our Privacy Policy, which forms part of these terms. By using BSMNT, you also agree to the Privacy Policy.
These terms are governed by the laws of New Zealand. Any disputes will be resolved in the courts of New Zealand. If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force.
